Child adoption racket: Mistry's anticipatory bail plea rejected

Syed Amin Jafri in Hyderabad

The anticipatory bail petition of Roda Mistry, one of the accused in the child adoption racket, was dismissed by the metropolitan sessions judge on the ground that a prima facie case was made out against her.

The judge, K C Bhanu, rejecting the plea on Friday, observed that serious allegations were levelled against Mistry, president of the Indian Council of Social Welfare, by the prosecution which claimed that her role in selling children in the guise of adoption through Precious Moments Home run by Anita Sen, was established beyond doubt.

Roda Mistry had filed the anticipatory bail petition earlier this week, apprehending imminent arrest by the Crime Investigation Department, which had filed a charge sheet against her.

The CID alleged that Mistry aided Anita Sen in illegal adoptions and collecting donations.

Mistry's counsel had contended that she had dealt with the adoptions duly following the prescribed procedures. The counsel also claimed that Mistry was seriously ill and was not in a position to recognise people.

The ICSW has been in the news since the child adoption racket surfaced in April this year. The Central Adoption Resource Agency, the regulatory body for adoption of children, had withdrawn its recognition to ICSW, even as Mistry voluntarily surrendered the licence of her adoption home in May this year, in the wake of the controversy over child trafficking.

On June 19, as many as 18 kids were rescued from ICSW's children home by the child welfare department and shifted to Sishu Vihar, the children's home run by the state government. The rescued included 10 disabled children and three mentally retarded kids. Five children, who were normal, were being sheltered at another licensed adoption home. All the children were in the age-group of five months to 14 years.
