SC to hear petition on J&K election on Monday

With the Election Commission deferring the polls in Gujarat on account of irregularities in the voters' list, the Supreme Court will hear a petition on Monday seeking postponement of the election in Jammu & Kashmir on the ground that the state electoral rolls have not been revised since 1988.

A bench comprising Justice R C Lahoti and Justice Brijesh Kumar had raised two questions on the admissibility of the petition filed by Panthers Party chief Bhim Singh and asked him to make up the deficiencies by Monday, when the case will be heard.

The bench asked Singh why he did not approach the Jammu & Kashmir high court and also whether he had given any representation to the Election Commission about the alleged irregularities in the electoral rolls.

Singh, who claimed to have given written representation to the Election Commission in this regard, has said in his petition: "It is an admitted fact that nearly 1,50,000 names of voters who died from 1990 till date have not been removed from the existing electoral rolls."

The petitioner sought a direction from the court to the Election Commission and the state government to prepare the voters' lists in accordance with the Registration of Electoral Rules, 1960.

In Gujarat, the commission had found the situation on the ground in relation to the electoral rolls, photo identity cards and relief and rehabilitation measures unsatisfactory and ordered a special revision of the rolls with house-to-house enumeration in 20 riot-affected districts.
