Nadeem is an accused in the Gulshan Kumar murder case, and is living in UK currently. The application has been made by his father.
Division bench of Justices Ranjana Desai and A V Mohta, while adjourning the case till next week on Nadeem's lawyers' request, made an observation that "a man who does not submit to the jurisdiction of Indian court will not get any relief."
"It is a question of dignity of our courts," Justice Desai said, when Nadeem's lawyer sought to put before an order passed by UK court in Nadeem's case.
However, Justice Desai made it clear that what she said was merely a prima facie observation and not an order. "We are not on merit of his application," the judge clarified.
Nadeem's extradition from UK was stopped by the order of Supreme Court of that country as his lawyers pleaded that Indian judicial system was not fair.
NBW and red corner notice were issued against Nadeem, a prime accused in the Gulshan Kumar murder case, in September 1997 following extradition proceedings initiated by Indian government in UK.
The present application, filed by his Mumbai-based father Yunus Saifee, says that NBW and red corner notices issued by Interpol have hindered Nadeem's movement as he cannot travel outside UK where he has taken asylum.
